Terms and Conditions

These terms and conditions ("Terms") govern access to and use of 103 Finder, a desktop application for advanced music search within the Discogs ecosystem, operated by Daniel Devesa ("103 Finder", "we", "us" or "our"). By registering, downloading or using the application, you agree to these Terms in full. If you do not agree, do not use the application.

1. Service description

103 Finder is a desktop application (Windows and macOS) that enables advanced music search using filters not natively available on Discogs: year ranges, marketplace availability, YouTube presence, have/want counts, community ratings, country filtering and other advanced parameters.

The software is licensed to you, not sold. This licence is personal, non-exclusive, non-transferable and revocable.

2. Eligibility and age requirements

You must be at least 13 years of age to use 103 Finder. By using the application you confirm that you meet this requirement. If you are under 18 years of age, you may only use the application with the consent of a parent or legal guardian.

3. Usage requirements

To use 103 Finder you need: (a) an active Discogs account (discogs.com), (b) a Discogs personal access token generated from your Discogs account, and (c) an active 103 Finder subscription or valid trial period. 103 Finder is not responsible for Discogs' terms of use, availability or policy changes.

4. Discogs API usage

103 Finder uses the official Discogs API to search its database. 103 Finder is not affiliated with, sponsored by, or endorsed by Discogs. Discogs is a trademark of Zink Media, LLC.

Searches are performed from your device using your own Discogs personal access token, stored locally on your machine. 103 Finder does not store or transmit your Discogs token to any external server.

Catalog data used for pre-filtering is sourced from the official Discogs data dumps (data.discogs.com), released under CC0 (public domain).

5. Subscription and payments

Full access to 103 Finder requires a subscription of €10 per month. Billing and subscription management are handled through Stripe (stripe.com), a third-party payment processor. By subscribing you also agree to Stripe's terms of service.

Subscriptions renew automatically each month until cancelled. You may cancel at any time from your billing panel; access continues until the end of the current paid period. No partial refunds are issued for unused time within a billing cycle.

6. Refund policy

Due to the nature of digital subscriptions, payments are generally non-refundable once a billing cycle has started. If you believe a charge was made in error, contact us at hola@103finder.shop within 14 days of the charge and we will review your case.

7. Free trial

New users may access a free trial of 1 hour of active usage. Time is counted only while the application is actively in use. Each account, device and network may only activate one trial period. No payment method is required to start the trial. After the trial ends, access is suspended until a subscription is activated.

8. Referral programme

103 Finder offers a referral programme that awards one month of free access for each new paying subscriber referred by an existing subscriber. Credits are applied automatically when the referred user completes their first payment. Referrals are subject to anti-fraud checks. Credits obtained through fraudulent activity will be revoked and the associated accounts may be terminated.

9. Account and access

Access to 103 Finder is tied to a personal account that is non-transferable. Simultaneous use on more than one device may require an access transfer from the settings panel. Sharing login credentials with third parties is prohibited and may result in immediate termination of your account without refund.

10. User obligations

You agree not to:

  • Reverse engineer, decompile or disassemble the application.
  • Copy, redistribute or sublicence the application or any part of it.
  • Use the application to scrape, harvest or extract data in bulk.
  • Attempt to circumvent subscription, trial or anti-fraud systems.
  • Use the application for any unlawful purpose or in violation of any applicable regulation.
  • Create multiple accounts to abuse the free trial or referral programme.

11. Privacy

Your use of 103 Finder is subject to our Privacy Policy, which describes how we collect, use and protect your personal data. By using the application you also agree to our Privacy Policy.

12. Intellectual property

103 Finder, its code, design, brand and original content are the property of their respective developers. Music data displayed in the application belongs to Discogs and its respective contributors, under Discogs' terms of use. Bulk or automated extraction, copying or redistribution of data from the application is not permitted.

13. Disclaimer of warranties

103 Finder is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted or error-free operation of the application.

14. Limitation of liability

To the maximum extent permitted by applicable law, 103 Finder and its developers shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of data, revenue or profits, arising out of or in connection with your use of the application. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.

We are not responsible for Discogs API changes, outages or data inaccuracies that may affect the application's functionality.

15. Termination

We reserve the right to suspend or terminate your access to 103 Finder at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination you must stop using the application. No refunds will be issued for remaining subscription time in cases of termination due to violations.

16. Modifications to the service

We reserve the right to modify, suspend or discontinue any part of the service at any time. We will make reasonable efforts to notify users of significant changes. Continued use of 103 Finder after such changes constitutes acceptance of the modified service.

17. Modifications to these terms

We reserve the right to update these Terms at any time. Material changes will be notified by email or via an in-app notice. Continued use of 103 Finder after notification implies acceptance of the updated Terms.

18. Third-party services

103 Finder integrates with third-party services including Discogs (search data), Stripe (billing) and Supabase (authentication and data storage). Your use of these services is governed by their respective terms. 103 Finder is not responsible for the practices or content of third-party services.

This application is distributed directly by 103 Finder and is not affiliated with Apple Inc. Apple is not responsible for the application, its content, or compliance with these Terms.

19. Governing law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or related to these Terms or your use of 103 Finder shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
